  • This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.theantiquestory.com (Website).

 

  • The Website is owned by Arteternal Traders LLP, a Limited Liability Partnership incorporated under the LLP Act, 2008 with its registered office at 1651/1/3/1 - Suma-Chandra, Kittur-591115 - Karnataka. 

 

  • These Terms and Conditions govern Your use of the Website and Services (as defined below) provided through the Website. By using or visiting the Website, or by using any content or information provided as part of the Website/Services, You shall be deemed to have read, understood and accepted to be bound by these Terms and Conditions.

 

  • For the purpose of these Terms and Conditions, wherever the context so requires "You/you", “Your/your” or “Customer/customer” or “User/user” shall mean any natural or legal person who uses the Website for availing the Products and Services provided thereby. The term “We/we”, “Us/us”, “Our/our” shall mean the LLP, its employees, and authorized agents that perform any services on the LLP’s behalf.

 

  • When you use any of the services provided by us through the Website, including but not limited to, antiques, vintage products, design services, art pieces, paintings, sculptures, ., You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms and Conditions and shall be considered as part and parcel of this Terms and Conditions.

 

  • ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS, SO PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these, you also accept and agree to be bound by the LLP Policies including but not limited to Privacy Policy available on antiquestory.com as amended from time to time.

 

  1. MODIFICATION AND RETURN POLICY

 

  • LLP reserves the right in its sole discretion and at any time, to:

 

  • discontinue or modify any of our Terms and Conditions and/or our Privacy Policy as we deem necessary or desirable; or

 

  • change, suspend, discontinue, or restrict your access to all or part of the Services (including without limitation, any feature, database, or content), at any time without any prior written notice to You.

 

  • We may, in our sole discretion, refuse to offer the Services to any person and/or entity or change the eligibility criteria for the Products/Services at any time. Your continued use of the Website following the posting of changes will mean that you accept and agree to the revisions. As long as you comply with these Terms and Conditions, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.
  • We also have a "no returns, refunds or exchanges" policy.  So please inspect every item carefully since they may be previously owned.

Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. As a minor if you wish to use or transact on website, such use or transaction may be made by your legal guardian or parents on the Website. A LLP reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to the notice or if it is discovered that you are under the age of 18 years.

  • While trading with/through LLP, unless we allow "guest" purchases, you will need to establish an account with us (“Account”) to use certain features of the Services (e.g., to order products and services from the Website). You may only create one account with us, and LLP reserves the right to immediately terminate any additional accounts created by you. You are solely responsible for protecting and maintaining the security and confidentiality of the password and account, and are fully responsible for all activities that occur under the password. You must provide accurate and complete information and keep your Account information updated.   • If you create an account, you represent and warrant that: (a) you will not select or utilize a user name of another person with intent to impersonate that person; (b) you will not select or utilize a user name in which another person has rights, if you do not have that person's authorization to use such name; (c) you will not select or utilize a user name that LLP in its sole discretion deems offensive; and (d) you are not a competitor of LLP, or an agent thereof.

 

  • You should never publish, distribute or post login information for your Account.

 

  • You shall have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.

 

  1. TERMINATION AND EFFECT OF TERMINATION
  • We may terminate these Terms of Use with respect to You, immediately without notice in the event of any breach by You of these Terms of Use or any of our applicable policies, as posted on the Website from time to time or upon a misuse of the Services by You.

 

  • You agree that upon the termination of these Terms of Use, We may delete all information related to You with respect to the Services availed by You. Further, You will no longer be able to log into the Website.

 

  • All provisions of these Terms and Conditions which by their nature shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity, limitations of liability, and payment obligations. Termination shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.

LLP does not charge any fee for browsing and buying on the Website. In particular, LLP may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event LLP reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to the LLP.

  • The fact that we make sure all objects are vintage but in some cases due to reproduction / duplication there might be issues and therefore will not be held responsible.

 

  • The products are sourced from reputed dealers, but if any products end up as stolen goods, we will not be held responsible.

 

  • Product images are for illustrative purposes only and may differ from the actual product. Due to differences in monitors, colours of products may also appear different to those shown on the website.

 

  1. PERMITTED USE AND RESTRICTIONS

  • For the time being, you shall not enter into any transaction in an item or service prohibited under any applicable law, including exchange control laws or regulations.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right, prior to the acceptance of your order pursuant to our Order Acceptance Policy described below, to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge.

  1. ORDER EXCEPTANCE POLICY

 

Your receipt of an electronic or other form of confirmation of order does not constitute our acceptance of your order or a confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason at any time after receipt of your order. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order. Your order will not be accepted until we send you (or the part accepted) the shipping information for the order.

 

  1. PAYMENT TERMS

 

    • For each product or service you order through the Services, you agree to pay the price applicable for the product or service (including any GST, surcharges and any delivery fees for the delivery service you select) as of the time you submitted the order. All prices are non-refundable. Without limiting other remedies, we reserve the right to charge a late fee on all past due payments equivalent to the lesser of one and a half percent (1.5%) per month on the unpaid balance or the highest rate allowed by law. You will pay for all collection costs, attorneys’ fees, and court costs incurred in the collection of past due amounts.

 

  • We use a third-party payment processor (the ‘Payment Processor’) to process your payments. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to this Agreement. We are not responsible for error by the Payment Processor.

 

  • Payment:

 

  • While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

 

  • Lack of authorization for any transaction/s, or

 

  • Exceeding the preset limit mutually agreed by You and between "Bank/s", or

  • All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.

 

  • Before shipping / delivering your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase.   • Transactions, Transaction Price and all commercial terms such as Delivery, Dispatch of products and/or services are as per principal to principal bipartite contractual obligations between Buyer and us and payment facility is merely used by the LLP.   • Payment Facility for Buyers:

 

  • You, as a Buyer, understand that upon initiating a Transaction you are entering into a legally binding and enforceable contract with the LLP to purchase the products and /or services from the Website using the payment facility, and you shall pay the transaction price through your issuing bank using payment facility.

 

  • You, as a Buyer, may agree with the LLP through electronic communication and electronic records and using the automated features as may be provided by payment facility on any extension / increase in the dispatch and/or delivery time and the transaction shall stand amended to such extent. Any such extension / increase of dispatch / delivery time or subsequent novation / variation of the transaction should be in compliance with payment facility rules and policies.

 

  • You, as a Buyer, shall be entitled to claim a refund of the transaction price (as your sole and exclusive remedy) in case you receive damaged goods, within 25 days. In case you do not raise a refund claim using Website features within the stipulated time then this would make you ineligible for a refund.

 

  • You, as a Buyer, understand that the payment facility may not be available in full or in part for certain category of products and/or services and/or transactions as mentioned in the policies and hence you may not be entitled to a refund in respect of the transactions for those products and /or services.

 

  • Refund shall be made in Indian Rupees only and shall be equivalent to the transaction price received in Indian Rupees.

 

  • For electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).

 

  • Refund shall be conditional and shall be with recourse available to LLP in case of any misuse by Buyer.

 

  • Refund shall be subject to Buyer complying with Policies.

 

  • LLP reserves the right to impose limits on the number of transactions or transaction price which LLP may receive from on an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit.

 

  • LLP reserves the right to refuse to process transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with LLP or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.

 

  • LLP may delay notification of confirmation of payment to buyers carrying out high transaction volumes to ensure transaction security and transaction price Furthermore LLP may hold the transaction price without dispatch or transfer the transaction price to law enforcement officials / or any other person (instead of reimbursing the same to Buyer) under a binding order or at the request of law enforcement officials, or in the event that the Buyer is engaged in any form of illegal act.

 

  • Compliance with Laws:

 

In the case of Properties which have been categorised by the Website as antiquities as defined under the Antiquities Act and Art Treasures Act, 1972, any statement made by the Website in relation to such Property, whether orally or in writing, concerning its attribution, like any school of art or craftsmanship, country or origin, history, authenticity or provenance, are only expressions of opinion or belief and do not constitute a representation, warranty or assumption of liability of them in any manner whatsoever and the LLP or the Website will not be liable for errors or omissions in any of the opinions with respect to authenticity, provenance, description, or condition of such Property.   • All valid credit debit cards and other payment instruments are processed using a payment gateway or a suitable payment system infrastructure and are also governed by the terms and conditions agreed between the buyer and the respective issuing bank and payment instrument issuing company.

 

  • All online bank transfers from valid bank accounts are processed using the gateway provided to the users by the respective issuing bank, which supports the payment facility. A ‘Dispute’ can be defined as a disagreement between a Buyer and a LLP in connection with a transaction on the Website.

 

  • How is a ‘dispute’ created?

 

Whenever there is a disagreement, the Buyer can write to info@theantiquestory.com in order to raise a dispute. Disputes can be raised at a particular transaction level.

 

  • What are the various types of ‘disputes’?

 

Following are the indicative examples of potential disputes:

 

  • Wrong item received
  • Item Not as described
  • Damaged

  • Buyer Protection Program

 

  • In case of a dispute where the LLP is unable to provide a replacement, LLP will actively work towards reaching a resolution.

 

  • The Buyer can write to info@theantiquestory.com if the issue with the LLP is not resolved. LLP’s customer support team will look into the case to check for possible fraud. Only after verifying these facts, a dispute can be registered.

 

  • In due course of resolution, LLP’s customer support team will facilitate a conference call between the LLP and the Buyer.

 

 

  • Buyer Eligibility and Restrictions

 

  • Only the Buyers who have purchased the product from LLP are eligible for the Buyer Protection Program.

 

  • Buyers can file a dispute within 3 days from the date of delivery of the product.

 

  • Any damage or loss to the product after delivery will not be covered under this program and will completely be the Buyer’s responsibility. Buyers should refuse to accept delivery if the item is damaged.

 

  • To be able to take advantage of the Buyer Protection Program, Buyers should first contact the LLP and attempt to resolve the issue. If the Buyer doesn't hear from the LLP or is unable to resolve the issue with the LLP even after contact, a dispute can be raised with LLP by writing an email to info@theantiquestory.com.

 

  • Fraudulent charges and claims are not covered under replacement/return policies.

 

  • If the Buyer has already initiated chargeback through the credit card issuing bank, it will not be covered under replacement policies.

 

  • Blacklisted and blocked Buyers are not covered by the replacement/return policies.

 

  • Buyers who have reached their maximum limit for claims are also not eligible. Buyers can make a maximum of 5 claims per year on LLP. If the claim was withdrawn, it is not counted. The coverage amount will be limited to Rs.50,000/-.

 

  • Raising disputes against LLP does not automatically entitle the Buyer to a replacement for the product purchased. LLP shall verify the disputes so raised and may process only such claims that are valid and genuine.

 

  • LLP shall at no point be responsible for any direct or indirect losses, expenses, costs of any nature whatsoever that may be incurred by any Buyer.

 

  • Claims of the nature of ‘Buyer remorse’ (i.e. instances where products are bought by the Buyer by mistake or where the Buyer chooses to change his/her mind with regard to the product purchased by him) will not be entertained through this program.

 

  • LLP reserves its right to initiate civil and/or criminal proceedings against a User who, files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, LLP may at its sole discretion suspend, block, restrict, cancel the user-name [and its related user-names] of such User and/or disqualify that user and any related users from availing protection through this program.

 

  • Decisions made by LLP under the replacement policies shall be final and binding on its Users.

 

  • LLP reserves the right to modify / discontinue replacement policies without any prior notice period to its Users.

 

  • Through this program, LLP shall not entertain claims of Buyers who have incurred loss due to delayed shipment or delivery of the item by the LLP.

 

  • E-mail Abuse & Threat Policy

 

  • Private communication, including email correspondence, is not regulated by LLP. LLP encourages its Users to be professional, courteous and respectful when communicating by email.
  • However, LLP will investigate and can take action on certain types of unwanted emails that violate LLP policies. Such instances may include, but are not limited to, the following:

 

  • Threats of Bodily Harm: LLP does not permit Users to send explicit threats of bodily harm.

We try to      update our website as often as possible, but we sell our products first come first served,   so that an item can be sold but can still be seen on our website. We do our utmost to describe all items as explicitly as possible, providing as much history and detail as is known to us.
